The mandatory minimum sentence for a second driving under the influence (DUI) offense within 10 years are much more severe than for the first offense. If you are found guilty of Forsyth County DUI second offense, your punishment could include incarceration, probation, community service, fines, substance abuse education courses, and the loss of driving privileges. However, you should remember that fighting a second DUI charge is no different than the first—you just need an experienced defense attorney on your side who can investigate the evidence in your case to develop a strong defense strategy.

The mandatory minimum sentence for a second DUI offense could include between 90 days and 12 months in jail, though all but 72 hours of incarceration can be suspended or probated. You may be ordered to serve probation for 12 months, less any jail time served, as well as perform 30 days of community service. The fines for a second offense range from $600 to $1000, and you may also be required to complete a clinical assessment, substance abuse treatment, and drug and alcohol education classes.

You could face a three-year license suspension if convicted of a second drunk-driving offense within five years. While you do face a “hard” suspension for 12 months (meaning absolutely no driving), you could be granted an ignition interlock permit after completing a DUI and Drug Use Risk Reduction program. The ignition interlock is a small device that measures the alcohol on your breath before the vehicle can start. You may be eligible for a full license reinstatement after 18 months if you successfully complete a clinical evaluation and a 17-week drug and alcohol treatment program.

In addition to increased penalties, you could be required to turn over all of the license plates from the vehicles in your name. You must also pay a $25 fee to have your photo, name, address, and the details of your DUI arrest published in a local newspaper.
