Forsyth County DUI First Offense

Unlike other crimes for which a first offender may get only a very minor penalty, a driving under the influence (DUI) first offense in Forsyth County can lead to serious consequences. In addition to a lengthy driver’s license suspension, you could be ordered to spend time in jail.

When determining the penalties for a Forsyth County DUI first offense, the judge must go by the court’s minimum mandatory sentence, though the punishment could be increased at the judge’s discretion.  If this is your first offense, you could be ordered to serve 10 days to 12 months of jail time, with a minimum mandatory sentence of 24 hours in jail. Twelve months of probation could be ordered; however, it will be reduced by any actual jail time served. You may also be required to complete mandatory substance abuse education classes, perform 40 hours of community service, and pay expensive fines and court costs.

For a first DUI offense in Forsyth County, your license could be suspended for up to a year; however, upon successful completion of a DUI and Drug Risk Reduction course and paying a reinstatement fee, your license could be reinstated after 120 days. Your defense attorney may also help you apply for a limited driving permit that would allow you to drive to court-approved locations, such as work and school, during the license suspension period. If you fail to adhere to the terms of your limited permit or commit any other moving violations, the Department of Driver Services (DDS) could revoke your driving privileges for six months.

Underage drivers who are convicted of a DUI first offense face different penalties than drivers of legal age. If a minor has a BAC between .02% and .08%, he or she may be sentenced to a six-month driver’s license suspension and at least 20 hours of community service. Underage drivers with a BAC of .08% or higher could have their driver’s license suspended for 12 months.
