Forsyth County Breath Analyzer – Intoxilyzer 5000

Breathalyzer tests are used by Forsyth County police offers to determine a driver’s blood alcohol content (BAC). Because the legal limit in Georgia is .08%, you may be charged with drunk driving if your breathalyzer result is over this level. However, even if you test over the legal limit, a skilled DUI defense attorney may be able to challenge the results of the Forsyth County breathalyzer in an effort to win your case.
In Forsyth County, the Intoxilyzer 5000 is used to conduct breathalyzer tests. The defense attorneys at Head, Thomas, Webb and Willis have completed training by the manufacturer of the Intoxilyzer 5000 and are certified to operate and perform calibration and maintenance checks on the machine. Because of this training, they understand the test’s known weaknesses and are qualified to investigate your breathalyzer results.
One problem with the breathalyzer test is that it sometimes has difficulty differentiating between mouth alcohol and deep lung alcohol. Food trapped between a person’s teeth or in dental work can absorb alcohol, thereby inflating the results of the breathalyzer. The machine also assumes that everyone has a 1:2100 breath-to-blood ratio, and can produce a false reading if your ratio is different. Even something as innocuous as an elevated temperature could substantially raise your BAC.
Medical conditions, such as diabetes and hypoglycemia, as well as low-carb diets could cause you to go into ketosis, resulting in the production of acetone. Because acetone is in the methyl alcohol family, the breathalyzer measures it the same way as consumed alcohol.
The breathalyzer test must also be administered properly to be accurate. If the machine operator failed to watch the subject for at least 15 minutes before the test to ensure he or she does not consume anything, belch, or vomit, the results of the test may challenged. The same is true if the officer was not correctly trained and instructed the subject to blow into the breathalyzer for longer than necessary.
As you can see, Forsyth County breathalyzer test results can be challenged. To learn more, and for a FREE case evaluation, a FREE license suspension appeal letter, and a FREE copy of The DUI Book, please contact Head, Thomas, Webb and Willis today.
